1. About these terms

These terms govern your use of popplysortcompss.boats (the "Site"), operated by Popplysortcompss Nautica S.r.l., Company No. (REA) GE-512847, Via Antonio Gramsci 17, 16126 Genova (GE), Italy ("we", "us"). By using the Site you agree to these terms. If you do not agree, please do not use the Site.

2. What we provide

The Site publishes editorial guides and curated information about older yachts for sale in Italy. We are not the owner of any vessel shown and, unless expressly stated in writing, we do not act as a broker, agent or party to any sale. Listing details such as price, specification and condition are supplied by sellers or brokers and may change or be withdrawn without notice. Our guides are general information, not professional, legal, tax or surveying advice.

3. User obligations

When using the Site you agree to:

• provide accurate information when submitting an enquiry;
• use the Site only for lawful purposes and not to send spam, malware or misleading content;
• not attempt to gain unauthorised access to the Site, its servers or connected systems;
• not scrape, copy or republish content in bulk without our written permission;
• carry out your own independent checks, including surveys, sea trials and document verification, before purchasing any vessel.

4. Intellectual property

All text, illustrations, graphics, logos and design elements on the Site are owned by us or our licensors and are protected by copyright and other intellectual property laws. You may view and print pages for personal, non-commercial use. Any other use, including reproduction, modification or distribution, requires our prior written consent. Photographs supplied by third parties remain the property of their respective owners.

5. Third-party links

The Site may link to external websites. We are not responsible for their content, availability or privacy practices, and a link does not imply endorsement.

6. Limitation of liability

To the fullest extent permitted by law, the Site is provided "as is" without warranties of any kind. We are not liable for any loss arising from reliance on listing information, from transactions between buyers and sellers, or from any indirect or consequential loss, including loss of profit or opportunity. Where liability cannot be excluded, it is limited to €100. Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot lawfully be excluded, nor does it affect your statutory rights as a consumer.

7. Termination

We may suspend or restrict access to the Site, in whole or in part, at any time and without notice, particularly where we reasonably believe these terms have been breached. Sections that by their nature should survive termination, including intellectual property, limitation of liability and governing law, will continue to apply.

8. Changes

We may amend these terms from time to time. The updated version takes effect when published on this page. Continued use of the Site means you accept the revised terms.

9. Governing law

These terms are governed by the laws of the Italian Republic. If you are a consumer resident in another EU member state, you also benefit from any mandatory protections of the law of your country of residence.

10. Disputes

We encourage you to contact us first at [email protected] so we can try to resolve any concern informally. If a dispute cannot be resolved, the courts of Genoa, Italy, have jurisdiction, without prejudice to a consumer's right to bring proceedings in the courts of their place of residence. EU consumers may also use the European Commission's Online Dispute Resolution platform.
